Celkový maximální počet odebraných vozidel na základě veřejné zakázky tak činí 211. Realizace Předmětu plnění vymezeného v čl. I Rámcové dohody bude probíhat po celou dobu trvání Rámcové dohody, a to na základě jednotlivých Kupních smluv uzavíraných v souladu s ustanovením § 134 Zákona o zadávání veřejných zakázek. Serviciile ce vor fi prestate in perioada de derulare a Acordului cadru se regasesc descrise la nivelul caietului de sarcini. Estimarile cantitatilor minime si maxime care ar putea fi solicitate pe durata întregului acord-cadru si a celor care ar putea face obiectul unui singur contract subsecvent dintre cele care urmeaza sa fie atribuite pe durata Acordului cadru se regasesc in cadrul documentatiei de atribuire – anexa la caietul de sarcini (intrucat din cauza unor motive tehnice legate de limitarea nr de caractere nu pot fi completate la nivelul prezentei). Modificarea acordului-cadru/contractului de achiziţie publică, în cursul perioadei sale de valabilitate, se va putea efectua în condițiile prevăzute la art. 221 din Legea nr. 98/2016 și al prevederilor din cadrul Instrucțiunii ANAP nr. 1/2021. Având în vedere că documentaţia de atribuire conţine un set minim de informaţii specifice referitoare la estimări ale cantităţilor minime şi maxime care ar putea fi solicitate pe durata întregului acord-cadru, precum şi estimări ale cantităţilor minime şi maxime care ar putea face obiectul unui singur contract subsecvent dintre cele care urmează să fie atribuite pe durata acordului-cadru, subliniem faptul că aceste cantităţi minime şi maxime pe care autoritatea contractantă le stabileşte iniţial în documentaţia de atribuire şi ulterior în acordul-cadru reprezintă estimări ale unor cantităţi care ar putea fi solicitate pe durata întregului acord-cadru şi nu cantităţile exacte care vor fi achiziţionate, acestea din urmă putând fi mai mici, egale, sau mai mari raportat la cele estimate, în funcţie de necesităţile reale ale autorităţii contractante. Promitentul-Achizitor îşi rezervă dreptul/opțiunea de a suplimenta cantitatea estimată la nivelul documentației de atribuire cu până la maxim 50% din cantitatea maximă de servicii pentru acordul-cadru/contractul subsecvent, pentru fiecare categorie de servicii în parte. Preţul serviciilor care vor fi achiziţionate suplimentar în baza clauzei de revizuire va fi cel din propunerea financiară ce stă la baza acordului-cadru (ajustat după caz, conform formula de ajustare), perioada de timp în care se va putea utiliza această opţiune de către promitentul Achizitor: pe toată durata de valabilitate a acordului-cadru/contractului subsecvent. Având în vedere clauza de revizuire de mai sus, valoarea estimata a procedurii a fost exprimata sub forma de interval, valoarea minima a intervalului reprezentand valoarea estimata a prezentei proceduri in functie de care se vor evalua ofertele (care include si suma fixa pentru „ Alte sume necesare pentru implementare”, iar valoarea maxima reprezinta valoarea estimata ce contine si valoarea posibilelor suplimentari in baza clauzei de revizuire cu 50%. Clauza de revizuire - Servicii noi, care nu au fost prevazute initial in estimarea Acordului cadru, pentru asigurarea necesitatilor de intretienere si functionare a autovehiculelor si autoturismelor aflate in dotarea si/sau utilizarea autoritătii contractante aparute pe parcursul derularii Acordului cadru, in conditiile in care parcul auto se schimba, modifica, mareste. Promitentul-Achizitor isi rezerva dreptul/optiunea de a introduce servicii noi, cu pana la maxim 50% din valoarea maxima estimata pentru Acordul-cadru. Pretul serviciilor noi care vor fi introduse suplimentar in baza clauzei de revizuire va fi stabilit prin negociere intre partile contractante, la nivelul preturilor medii rezonabile existente in piata la momentul negocierii (media a trei oferte / liste de preturi). Modificarea de valoare scăzută prevăzută de art. 221 alin. (1), lit. f) din Legea nr. 98/2016 se tratează şi calculează distinct de modificarea în baza art. 221 alin. (1), lit. a) din Legea nr. 98/2016.
