Przedmiotem zamówienia jest zakup i montaż instalacji fotowoltaicznych oraz magazynów energii elektrycznej na obiektach publicznych w Gminie Myszków (obejmujące zaprojektowanie, dostawę, montaż i uruchomienie), w następujących ilościach: - liczba instalacji fotowoltaicznych: 8 sztuk, - liczba magazynów energii elektrycznej: 18 sztuk, - liczba budynków objętych projektem: 7 budynków. 2. Przedmiot zamówienia został szczegółowo opisany w załączniku nr 1 do SWZ – Program Funkcjonalno – Użytkowy stanowiącym opis przedmiotu zamówienia dla niniejszego postępowania. 3. Rodzaj zamówienia: dostawy. 4. Zamawiający nie określa wymagań w zakresie dostępności dla osób niepełnosprawnych, gdyż charakter tego zamówienia nie determinuje wystąpienia wymagań w zakresie dostępności dla osób niepełnosprawnych. 5. W każdym przypadku, gdy opis przedmiotu zamówienia będzie odnosił się do norm, ocen technicznych, specyfikacji technicznych i systemów referencji technicznych, o których mowa w art. 101 ust. 1 pkt 2 oraz ust. 3 ustawy Pzp, Zamawiający dopuszcza rozwiązania równoważne opisywanym, a odniesieniu takiemu towarzyszą wyrazy „lub równoważne”. 6. Jeżeli wymagane będzie złożenie certyfikatów wydanych przez określoną jednostkę oceniającą zgodność, o której mowa w art. 105 ust. 2 ustawy Pzp, Zamawiający akceptuje również certyfikaty wydane przez inne równoważne jednostki oceniające zgodność. 7. Przez jednostkę oceniającą zgodność, o której mowa w art. 105 ust. 2 ustawy Pzp, rozumie się jednostkę wykonującą działania z zakresu oceny zgodności, w tym kalibrację, testy, certyfikację i kontrolę, akredytowaną zgodnie z rozporządzeniem Parlamentu Europejskiego i Rady (WE) nr 765/2008 z dnia 9 lipca 2008 r. ustanawiającym wymagania w zakresie akredytacji i nadzoru rynku odnoszące się do warunków wprowadzania produktów do obrotu i uchylającym rozporządzenie (EWG) nr 339/93 (Dz. Zamawiający nie zastrzega obowiązku osobistego wykonania przez Wykonawcę kluczowych zadań, w trybie określonym w art. 121 ustawy Pzp dotyczących prac związanych z rozmieszczeniem urządzeń i ich instalacją w ramach przedmiotowego zamówienia. 9. Wykonawca może powierzyć wykonanie części zamówienia podwykonawcy. Zamawiający żąda wskazania przez Wykonawcę, w ofercie, części (zakresów) zamówienia, których wykonanie zamierza powierzyć podwykonawcom, oraz podania przez Wykonawcę nazw ewentualnych podwykonawców, jeżeli są już znani. W tym celu Wykonawca winien podać odpowiednie informacje w formularzu oferty, stanowiącym załącznik nr 3 do SWZ. W przypadku, gdy Wykonawca nie zamierza wykonywać zamówienia przy udziale podwykonawców, powinien wpisać w odpowiednim miejscu tabeli formularza oferty „nie dotyczy” lub inne podobne sformułowanie. 10. Powierzenie wykonania części zamówienia podwykonawcom nie zwalnia Wykonawcy z odpowiedzialności za należyte wykonanie zamówienia. 11. Powody braku podziału udzielanego zamówienia na części. Zamówienie jest udzielane w dwóch częściach stanowiących przedmiot odrębnego postępowania. Wszczęcie i prowadzenie dwóch odrębnych postępowań składających się na całe zamówienie spowodowane jest specyfiką i zakresem rzeczowym dostaw w ramach projektu OZE. Dalszy podział udzielanego zamówienia na części spowodowałby trudności w realizacji zamówienia w zakresie koordynacji i uzyskaniu projektowanych parametrów, zwiększenie kosztów inwestycji w szczególności, gdyby rozdzielić zadanie na dostawę a następnie ich instalację, występowałby problem „rozmycia” odpowiedzialności tych Wykonawców z tytułu gwarancji. Jeden Wykonawca ponosiłby odpowiedzialność z tytułu gwarancji za dostarczane urządzenia (moduły fotowoltaiczne, inwertery, magazyny energii) a drugi za ich zainstalowanie. W przypadku wystąpienia wad Wykonawca, który wykonywałby dostawę mógłby twierdzić, że wady są skutkiem wadliwej instalacji, z kolei Wykonawca, który instalował, że wady są wynikiem dostarczonych urządzeń. Również nie ma racjonalnego uzasadnienia podział zamówienia na części w oparciu o podział zakresu zamówienia. Taki podział spowodowałby zwiększenie cen urządzeń oraz kosztów ich montażu, co oznacza, że nie jest on tym samym uzasadniony z punktu widzenia ekonomicznego (przy większym zakresie zamówienia działa efekt skali obniżający cenę oferty). 12.
